Booking Terms & Condition

Please read these Booking Terms and Conditions carefully.

BY BOOKING YOUR HOLIDAY YOU AGREE TO THE TERMS AND CONDITIONS STATED BELOW.

The following booking conditions, together with all information on your holiday contained on our website, and in the quote, are the basis of your contract with West Cornwall Walking Holidays. We have tried to make them clear and easy to understand so that you are able to see our respective rights and obligations for your booking.

Holiday reservations are accepted by West Cornwall Walking Holidays on the following conditions:

  1. The booking is between the first named guest making the holiday booking and West Cornwall Walking Holidays.
  1. The booking is deemed to have been made once the first named guest has ticked the acceptance of conditions box (after having read the booking terms and conditions carefully) and has paid the deposit or the full price of the holiday in full (if within 12 weeks), whichever is relevant. A confirmation of booking will be emailed to you.

Booking a holiday

To make a booking please contact us so that we can confirm the availability of your trip and the total price. Once we have confirmed price and availability we will send you full details and prices in our quote. To make the booking please follow the instructions on the quote to confirm dates and options and make the deposit payment requested. All our holidays are subject to the availability of the accommodation. 

Prices

All prices for the holiday, both for couples and single guests are advertised on the website. Once your booking is confirmed by us we guarantee there will be no price alterations or surcharges unless changes are made to your holiday with your agreement or at your request.

Payments

Your invoice will have full details on how to make a deposit payment. We ask for a deposit payment when booking with the balance to be paid 12 weeks before the start date of your holiday. We are happy to accept payment by cheque or bank transfer. There are no surcharges for the type of payment used.

A booking is confirmed between us once we have received your first payment. We will contact you when your balance payment is due with a balance invoice.

If You Wish To Change Your Booking

Please contact West Cornwall Walking Holidays in the event of having to change your chosen route / holiday dates and we can advise on what costs would be involved. Please also see the notes below about Travel Insurance which may well cover these costs if you have to change dates due to unforeseen circumstances.

If You Wish To Cancel Your Booking

If you need to cancel your booking we require you to confirm this in writing (or by email) as soon as possible. In the unfortunate event of you deciding to cancel your holiday after booking, we operate an industry standard cancellation policy which is that the following charges will apply from the date that we receive your cancellation.

Cancellation Charges

If you decide to cancel your holiday for any reason the following charges will apply – see the section on Insurance Cover below, for details about protecting yourself from cancellation charges in the event of unforeseen last minute cancellations or curtailments (ending your holiday early).

If you cancel MORE than 8 weeks before arrival Cancellation charge – DEPOSIT ONLY
If you cancel LESS than 8 weeks before arrival Cancellation charge – 100% OF TOTAL COST

Insurance Cover Against Cancellation Charges

For your own protection, we suggest that all guests hold Holiday Insurance so that you are covered in case you need to cancel your holiday. In particular you need to make sure you have your own cover in case you decide to cancel your holiday or finish it early due to the ill health of you or anyone else in your party. This insurance is vital to protect you against any losses you will incur if you have to cancel your holiday after booking it.

You should also ensure that you are covered for loss of personal items or luggage and any illness, accidents or injury. West Cornwall Walking Holidays cannot be held responsible or liable in any way for customers who fail to take out adequate travel insurance. You and your party are responsible for ensuring that the travel insurance which you arrange is suitable for your individual needs. You are not covered for cancellation due to illness etc. if you do not have insurance in place.

Cancellations by West Cornwall Walking Holidays

For your peace of mind, none of our holidays require minimum numbers so that once we have accepted your booking your holiday will operate unless there are circumstances beyond our control.

In the unlikely event of us needing to cancel your holiday you will be able to choose to take an alternative holiday date or receive a full refund.

Minor Alterations by West Cornwall Walking Holidays

It is unlikely that we will have to make any changes to your holiday arrangements. However occasionally changes will have to be made and we reserve the right to do so at any time. Examples of minor alterations would be the closure of a short section of path by the authorities or the closure of a particular accommodation requiring us to secure an alternative. Such changes will only ever be made to ensure your safety and or enjoyment. We will notify you of any minor alterations at the earliest possible date and ensure your booking is adjusted to provide you with the holiday itinerary you booked.

If circumstances beyond our control such as injury or illness mean it is impossible to supply a guide for the walks, the guests will be supplied with a map and details of the route, and asked to guide themselves. Accommodation and transport to the start and finish of the walk each day will still be provided as usual. In this circumstance a reduction in cost of £100 per person will be reimbursed.

If a guest is unable to complete a section of the walk, transport back to the 

accommodation will be provided where possible, at additional cost.

Walks will be cancelled on a particular day if extreme weather conditions mean it is unsafe to either start or continue a walk. 

Major Alterations by West Cornwall Walking Holidays

If due to circumstances beyond our control, we needed to make a major alteration to your trip, such as changing your complete route or the dates the trip will run, you will be able to choose to accept the changes, or take an alternative holiday or receive a full refund.

We regret we cannot pay any expenses, costs or losses incurred by you as a result of any change or cancellation. No compensation will be payable if we cancel as a result of your failure to comply with any requirement of these booking conditions entitling us to cancel, such as paying on time.

Force Majeure

We regret we cannot accept any liability or pay any compensation where your holiday is prevented or affected by, or you otherwise suffer any damage or loss as a result of force majeure. 

Force majeure means any event which we, or any or our suppliers, could not, even with all due care, foresee or avoid. Such events include war or threat of war, riots, civil strife, terrorist activities, industrial disputes, fire, epidemics and viral pandemics including footpath closures due to foot and mouth, acts of any government, or public authority, changes imposed by the re-scheduling of airlines. Also natural or nuclear disasters, adverse weather conditions and all similar events outside our control. Your Travel Insurance policy will state what cover they would or would not provide in these situations.

Email

Wherever possible we will supply you with your invoice, correspondence and information using email as this helps to keep the prices of our trips down for you and also helps minimise our impact on the environment. However, if you are unable to receive information this way, we will use the normal postal service to get information to you.

Safety And Walking Route Advice

You must advise us about any medical conditions involving yourself or anyone in your group that may affect their ability to undertake a walking holiday.  In addition you must act sensibly and prudently at all times with regard to the safety of yourself or of anyone else in your group and of others and their property.

Your safety and enjoyment is of prime importance to us and we provide information about safety issues to be aware of on the walking route.

We may provide advice about the routes and on general walking issues from time to time as required by you and this also appears in the supplied route descriptions, maps and guidebooks if supplied because the guide cannot accompany you for any reason. Information or advice is given in good faith and is accurate to the best of our knowledge. However remember that “advice” is just that and should be used for guidance only and should not be relied on alone for making personal decisions about walking.

Only you (the guest) with knowledge of the background details and abilities of your party and of any given situation whilst actually on holiday can decide if the advice or suggestions are relevant and safe for you and others in your party. In doing this you can take into account your own capabilities and specific factors such as the weather and conditions of the trails on any given date.

Coastal and Moorland walking has a certain amount of inherent risk. Guests are provided with a Risk Assessment and safety briefing covering the guided walks and while every effort is made to minimise any risk the guests retain liability for their own decisions and actions and for deciding on the merits or otherwise of acting on any advice from West Cornwall Walking Holidays in any given situation and in no event shall West Cornwall Walking Holidays be liable for any personal injury, illness or any loss suffered as a result of, guidance, advice or information provided about walking routes. 

West Cornwall Walking Holidays will also not be liable for the loss or damage of a guests property.

Parental Responsibility

Parents or legal guardians of children under 18 undertake to take full responsibility and supervision of their children at all times. To satisfy current legislation, children under 18 will not be allowed to undertake West Cornwall Walking Holidays trips without their parent or legal guardian accompanying them.

Behaviour

When you book your holiday with us, you accept responsibility for the proper conduct of yourself and all members of your party during your holiday. We reserve the right at any time to terminate the stay of any party member(s) whose behaviour is, in the reasonable opinion of the accommodation provider or us, causing or likely to cause danger, upset or distress to anyone else or damage to property. Full cancellation charges will then apply and no refund will be given.

We are under no obligation whatsoever to pay compensation or meet any costs or expenses (including but not limited to alternative accommodation) you may incur as a result of your stay being terminated. If you cause damage to the accommodation in which you are staying, you must fully reimburse the accommodation supplier concerned for the cost of the damage before the end of your stay and you must indemnify us for the full amount of any claim (including legal costs) made against us by the accommodation supplier or any third party as a result.

Accommodation

West Cornwall Walking Holidays cannot be held responsible for any perceived inadequacies in any of the accommodation. Property description and all details written (and verbal) on our website and other booking information are given in good faith and are believed to be correct, but their accuracy cannot be guaranteed. 

Guests must keep their accommodation clean and in good order and will be responsible for any damages or breakages. During the holiday the guests are responsible for the care of the accommodation and its contents. It is expected that guests treat the accommodation with the respect that they treat their own and leave the accommodation and its fixtures and fittings in a clean and tidy condition, including correct disposal of rubbish / waste for recycling if applicable. 

Your guest accommodation is available from 3 p.m. on the first day of the holiday and must be vacated by 10 a.m. on the last day. 

Pets are not permitted at all.

There is no smoking or vaping allowed on the premises of any of the accommodations. 

Complaints

If you do have any problems concerning your holiday you should contact us immediately on the telephone numbers provided with your booking information sheet as we will do our best to resolve the situation immediately. If we are unable to do this, complaints should be put in writing to ourselves as soon as is reasonably practical and in any case within 14 days of the end of the holiday.

In the unlikely event of a complaint West Cornwall Walking Holidays reserves the right to refer it to arbitration by the Regional Board of South West Tourism. 

All matters arising from your contract with us are governed by English Law and are subject to the jurisdiction of the courts of England and Wales.

If you want further explanation of any of the detail in these terms and conditions please do not hesitate to contact us and we will help. They are not designed to confuse you but to make sure both we and you understand who is responsible for what in relation to your holiday booking!
